Marketing Shark (Marketing Shark LLC, "we", "us") runs the Marketing Shark app and website, marketingshark.app. Independent sales reps ("you") use it to share their pages, send people their own links, and follow up with their leads. This policy explains what we collect, why, and the choices you have.

1. Your account

When you sign up and use Marketing Shark we keep:

• your name, email address and mobile number
• your password, stored only in scrambled form by our sign-in provider
• your setup answers, such as your company username, links and social profiles
• your picture, if you add one (a photo you take or choose, or an avatar you build). It shows in your account and on the walkthroughs you send, so the people you send them to know they're from you
• your plan and billing history. Card payments go through our payment provider; we never see or store your full card number
• technical records, such as when you sign in and any errors you run into, so we can fix problems
• how you use the app: which screens you open, which of the app's buttons you tap (such as searching today's topic, copying a caption or a link, or opening a conversation we picked for you), when you open the app, and how many people you reached out to. We record the button, never what you type or copy. We use it to suggest your next step, show your progress, improve the app and notice when you might need a hand

2. About you, and the AI that writes your posts

On some plans you can answer a few questions a day about yourself, such as your family, where you live, your routines and the way you talk, and tap Personalize to have a post or message rewritten in your voice. If you use it, we keep:

• your answers, and whether you ticked Keep this private on each one
• the posts and messages written for you, and whether you copied or undid them, so the next ones fit you better
• when you tapped OK on its first screen

Your answers, and the captions you've written in the app, are sent to our AI provider, Anthropic, which writes the posts and messages from them. It may only use them to do that work for us, and does not use them to train its AI. An answer you mark Keep this private is used only as background and never appears in a post. Nothing is sent until you tap OK. Only you, our team and that provider see your answers; they are never shown to other reps, your team leader or the company you sell for. You can forget any answer, or all of them, at any time in About you, then What's in your Shark brain.

3. Your leads

When people fill in a form or quiz on your pages, what they give (such as their name, email, phone and answers) is stored here for you, along with the messages you exchange with them. You decide what happens to it. We hold it on your behalf to run the service and do not use it for our own marketing. Your pages carry their own Privacy Policy for your leads.

4. People you send a link to

When you send someone their own link, you either type their name or pick one person from your phone's contacts. We store only that person's name, and their number if you give it, to make their link and to tell you when they open it, how long they watch and what they tap. We never read or upload your address book: only the one person you pick leaves your phone.

5. Notifications

If you turn on notifications, we keep a token from your phone or browser so we can tell you about new leads, replies and your daily actions. Turn them off in Account, or in your phone's settings, at any time.

6. How we use it

• to run your account, your pages and your follow-ups
• to suggest what to do next in the app, from what you and your leads have done
• to see which parts of the app help reps most, so we can improve it
• to send the emails and texts you set up, and to tell you what your leads do
• if you use About you, to write posts and messages in your voice from your answers
• to bill you for your plan
• to answer you when you contact support
• to notice when you haven't opened the app for a while, so someone from our team can check in with you
• to keep the service secure and prevent misuse
• to meet legal requirements

7. Who else handles it

We never sell your information or your leads' information. We use service providers to host the service and its data, deliver emails and texts, take payments, answer support chats and write with AI (Anthropic, for About you and support), and they may only use the information to do that work for us. Text message consent is never shared with anyone for their own marketing.

The leaderboard in the app shows reps on the same system each other's first name, last initial, how many people they reached out to and their daily streak. Nothing else about you or your leads is shown. To take yourself off it, tap Account, then Leaderboard.

If you join a team, your team leader sees your name, your mobile number (so they can text you), your plan, when you last opened the app and your numbers: how many people you reached out to, your new leads, your daily streak and the customers you marked in the app. They never see your leads, your messages or anything your leads told you. You choose your team, and you can leave it at any time in Account, then Your team.

If you lead a team, reps in your company see your name and Shark username in the list of leaders they can pick from, and the people on your team see your mobile number so they can text you.

8. Cookies

The app uses cookies to keep you signed in and remember your choices. The app itself carries no advertising trackers, and how you use the app is never shared with advertisers or used to track you across other companies' apps or websites. Your own pages may carry an advertising pixel if you add one in Account.

9. How long we keep it, and deleting it

We keep your information while your account is open. To delete your account and everything in it, tap Account, then Delete my account in the app, or email marketingshark@sharksuite.ai. We stop your plan and delete your account, leads and messages within 7 days, and email you when it's done. We keep only what the law requires, such as billing records.

10. Your choices

You can see and change your details in Account at any time. Depending on where you live, you may also ask us for a copy of your information, to correct it, or to delete it: email marketingshark@sharksuite.ai.

11. Security

We use reasonable safeguards, including encrypted connections and access limited to the people who need it. No service is completely secure, so we cannot promise absolute security.

12. Children

Marketing Shark is a business tool for adults and is not meant for anyone under 18. We do not knowingly collect children's information.

13. Changes

We may update this policy. When we do, the date at the top changes, and for important changes we tell you in the app or by email.

14. If you are in the EU, the UK or Switzerland

Who is responsible. Marketing Shark is run by Marketing Shark LLC (712 West Ave, Ocean City, NJ 08226, United States), which is responsible (the "controller") for your account information. For your leads, you are the controller and we handle their information for you, only on your instructions (the "processor").

Why we may use it.

• to run your account, your pages and your plan: because it is needed for our agreement with you
• to keep the service secure, fix problems and answer support: our legitimate interest in a working, safe service
• to suggest your next step and improve the app from how reps use it: our legitimate interest in you getting results and in a better app
• to notice when you might need a hand and check in with you: our legitimate interest in you getting results from the service
• to show your numbers to the team leader you chose: your choice to join their team, which you can undo at any time
• to send you notifications: your consent, which you can turn off at any time
• to write your posts from your About you answers: your consent, given when you tap OK, which you can withdraw at any time by forgetting your answers or emailing us
• to keep billing records: because the law requires it

Where it is stored. Our servers and most of our service providers are in the United States. When your information goes there, it is protected by the European Commission's Standard Contractual Clauses, or by the provider's certification under the EU-U.S. Data Privacy Framework (and its UK and Swiss extensions).

How long we keep it. Your account, leads and messages: while your account is open, and deleted within 7 days of you deleting it. Sign-in and error records: only as long as we need them to fix problems and keep the service secure. How you use the app: the detail for 30 days, then only daily totals, kept while your account is open. Billing records: as long as tax and accounting law requires.

Your rights. You may ask us for a copy of your information, to correct it, to delete it, to limit how we use it, to object to a use based on our legitimate interest, or to receive it in a file you can take elsewhere. Where we rely on your consent, you can withdraw it at any time. Email marketingshark@sharksuite.ai and we answer within one month. You may also complain to the data protection authority where you live or work.
